The process of creating a company in Spain involves several essential steps that must be followed in a specific order.

It all starts with obtaining the NIF (Tax Identification Number) for all non-Spanish shareholders. This is a mandatory first step.

Next, we must secure your desired company name by requesting a Name Certificate (Certificado Negativo de Denominación Social) from the Central Mercantile Registry.

With these steps completed, we draft the company bylaws (estatutos sociales), which define the rules of your company. We then sign the public deed of incorporation before a Spanish notary and handle the entire registration process with the Spanish Commercial Registry.

Every foreign founder and director must first obtain a Spanish Foreigner’s Identification Number (NIE).
The proposed name for your company must not already be in use by any other company in Spain.
