What is the Family Reunification in Spain

About the service

What is the Family Reunification in Spain?

Family Reunification in Spain is the legal right of any non-EU foreign resident to bring their direct family members to live with them in the country. This process ensures that families can stay together, creating a stable and supportive environment for everyone.

This is your path to sharing your life in Spain with those who matter most.

The process is designed for legal residents who have lived in Spain for at least one year and have obtained authorization to reside for at least another year. You, the resident in Spain, are the “sponsor” (reagrupante).

You can reunify your spouse or registered partner, your minor children (or those of your partner), and, under specific conditions, your parents or parents-in-law over 65 who are financially dependent on you.

To get the residence permit for family members, two main requirements must be met: proving you have sufficient financial means to support the family unit and demonstrating you have adequate housing through an official report.

The financial requirement is calculated based on Spain’s IPREM. You’ll generally need 150% of the IPREM for a family of two, adding 50% for each additional member.

The family reunification process has two distinct phases. First, you, the sponsor, must apply for an initial authorization at the Immigration Office in Spain.

Once this authorization is granted, your family member has two months to apply for their reunification visa at the Spanish Consulate in their country of origin.

After obtaining the visa and traveling to Spain, they must apply for their Foreigner Identity Card (TIE) within one month.

Our role is to ensure both phases of the process are successful. We help you build a solid financial case, prepare you for the housing report, and manage all communications, turning the complex dream of reunifying your family in Spain into a well-organized and successful reality.

I had an amazing experience working with Dario and his team throughout my visa process. They made everything completely stress-free and were incredibly helpful every step of the way. Dario speaks excellent English, which made communication easy and comfortable, and he was always responsive, patient, and clear in explaining everything. He and his colleagues handled every detail with care, efficiency, and in a very timely manner, which gave me a lot of confidence and truly made my life so much easier throughout the entire process. By far the best lawyer I’ve worked with in Barcelona. I couldn’t have asked for a better experience and would highly recommend Dario and his team to anyone needing help with visas or immigration.

A friend recommended Illay Legal to help obtain my permanent residency in Spain. Exceptional service! Marc explained every part of the process clearly and precisely. Once I provided all the necessary details, the team did all the work: pre-completed the necessary paperwork, helped retrieve padron and digital tax certificate, secured appointments in my preferred neighbourhood and checked in with me before and after both appointments. I subsequently switched both my tax and business accountancy contracts to Marc's firm and have enjoyed the same very high level of service. Communication via email and WhatsApp, and extremely responsive to answering any small or large questions/concerns. A huge endorsement to the whole team - I would highly reccomend. Regards Ismail

Lawyers I truly trust and genuinely enjoy working with. Huge thanks to Marc and Soundous for guiding me through a very stressful documentation process over the past few years. Together we managed to resolve a complicated situation I ended up in because of a bureaucratic issue with my previous paperwork. They have well-organized processes and a lot of experience with different kinds of cases — even the tricky ones. Whenever I was stressed or freaking out, they were always there to reassure and support me. That human approach means a lot. With them, you are in very good hands 💚

FAQ

Frequently asked questions about the Family Reunification in Spain

Can I reunify my parents if they are under 65?

It is very difficult. The law requires parents to be over 65. For parents under 65, you would have to prove there are exceptional humanitarian reasons that necessitate their residence in Spain, which is a very high bar to meet.
Yes. Once your spouse obtains their residence and work permit through reunification, they are automatically authorized to work in Spain, either for a company or as self-employed, without needing any additional administrative steps.
Your ex-partner can maintain their residency permit independently if they can prove they have lived together in Spain for at least two years and meet other requirements, such as having a job or sufficient financial means.
No. A key requirement is that you, the sponsor, must have already obtained your first residency renewal. This means you must have completed your first year and have authorization to reside for at least one more year.
Only in specific cases. You can reunify children over 18 if they are financially dependent on you and have a disability that prevents them from providing for their own needs. Simply being a student is not enough.

Guiding you in every step to your bright future.
