These are requirements for Employee Relocation to Spain applicants:

Application Form MI-T or EX-03: The official model, signed by your company's legal representative.
Company's Legal Documents: Your company's NIF, deeds, and proof of being up to date with taxes.
Employee's Full Passport: A complete and valid copy of the employee's current passport.
Employee's CV & Qualifications: Their university degree or documents proving the required professional experience.

Signed Work Contract or Offer Letter: The document specifying the job conditions, duration, and salary.
Company Report Justifying the Relocation: A descriptive report on the project and the employee's role.
Employee's Criminal Record Certificate: Legalized or apostilled document, and officially translated as required.
Proof of Prior Relationship (for ICT): Documents proving the employee has been with the group for 3 months.

Can we hire someone who is already in Spain as a tourist?

What is an Intra-Company Transfer (ICT) permit?

It’s a special permit for moving existing employees from a company in your corporate group located outside the EU to your Spanish branch. The employee must have been with the company for at least 3 months.

Do we, as a company, have to prove there are no suitable candidates in Spain?

Not for the fast-track routes. For the ICT, Highly Skilled Professional, and EU Blue Card permits, you do not need to consider the National Employment Situation. This is only a requirement for the standard work permit.

Does the employee's family get residency at the same time?
