About the service

What is the Tax Inspections in Spain?

A tax inspection in Spain (inspección de Hacienda) is a formal review process initiated by the Tax Agency (Agencia Tributaria) to verify that you have correctly declared and paid your taxes. Facing this process alone is a significant risk.

It all begins with a certified letter: a notification or requirement (requerimiento) requesting information about a specific tax or period. This is the moment to act, not to wait.

The inspection can range from a limited check (comprobación limitada) focused on a single issue, to a full-blown, comprehensive audit of your entire financial situation over several years.

The inspector will request documents, accounting records, invoices, and bank statements, and may ask you to attend meetings to answer questions. Your responses are legally binding and will determine the outcome.

The process concludes with an assessment from the inspector. If they find irregularities, they will issue a provisional tax settlement proposing a payment. If you disagree, the case proceeds to a formal disagreement (acta de disconformidad), which is the precursor to potential penalties.

Our role is to become your legal shield from the very first moment.

We immediately notify the Tax Agency that we are your official legal representatives, and all future communications will be directed to us. You will not have to speak to the inspector directly.

We analyze the scope of the inspection, build a robust legal defense strategy, and meticulously prepare all the documentation required. We attend all meetings on your behalf, defending your position with technical and legal arguments.

Our goal is to resolve the inspection as favorably as possible: either by demonstrating full compliance and closing the file without charges, or by significantly reducing the proposed settlement and eliminating or minimizing any penalties.

FAQ

Frequently asked questions about the Tax Inspections in Spain

Why has the Tax Agency selected me for an inspection?

It can be for many reasons: a random check, inconsistencies between your declarations and the data they have from third parties (like banks or your employer), or because you are in a sector they are focusing on. It does not automatically mean you have done something wrong.
Never, without a professional review. The Tax Agency’s initial proposal is often a maximalist interpretation. A tax lawyer can almost always find arguments to challenge the assessment, significantly reducing the amount or even nullifying it.
The legal maximum duration for a general inspection is 18 months, which can be extended to 27 months in complex cases. A more limited check is usually resolved faster, but it can still take several months.
Ignoring a notification is the worst possible action. It leads to the loss of your right to defend yourself, automatic penalties (often the highest possible), and the Tax Agency can proceed to seize funds directly from your bank accounts.
It depends. Signing an agreement can reduce penalties by 30%, but it also means you waive your right to appeal. We will always advise you on whether it is strategically better to agree or to fight the assessment based on the strength of our legal arguments.
